Lee's mortgage finance career began in 1970, including serving as Administrator for Patriot Mortgage Co. of El Paso, with a deep background in real estate and underwriting. He founded ABR Capital Funding, Inc. and has served as its CEO since inception. Lee holds a Degree in Finance from Stanford University (1969) and an Associate Degree from the School of Mortgage Banking at Northwestern University.

Your investment is structured as a promissory note backed by ABR's portfolio of legally assigned government invoices. Both the contractor and the government agency legally assign their payment rights to ABR for each transaction. The notes themselves are general obligations of ABR First Capital, LLC. The underlying payor is a US government agency — federal, state, or local — contractually obligated to pay invoices for services already delivered and accepted. No stock market exposure. No real estate collateral risk. No private borrower credit risk. The primary risks include government payment delays or disputes, contractor default, and operational risks of the Company. InvestABR is open exclusively to accredited investors as defined by the SEC under Rule 501 of Regulation D. Generally, this means individuals with net worth exceeding $1 million (excluding primary residence), or annual income exceeding $200,000 ($300,000 jointly). Our team will confirm your eligibility during the onboarding process.
Because we legally own the invoice — not just a claim on it — and because the government contracting authority has assigned payment directly to ABR under the Assignment of Claims Act, the government's payment obligation runs to ABR and is designed to continue regardless of the contractor's financial status. This structure is intended to keep ABR outside the contractor's bankruptcy estate. If the IRS pursues a contractor for back taxes, the IRS has historically subordinated its collection to ABR so the contractor can continue operating and servicing their debt. Legal outcomes in any specific insolvency depend on the facts and applicable law.
In 30+ years of operation, no investor funds have been garnished by the IRS. At the client (contractor) level, there was one IRS garnishment instance in that time, and the funds were returned to ABR in full. We file an IRS Form 8821 Tax Information Authorization for every client, which gives us advance notice of any IRS collection issue so we can stop advancing and wind down exposure early. Multiple layers of legal protection are in place: (1) Assignment of Claims Act — the government contract is legally modified so all invoice payments are legally required to go directly to ABR; (2) UCC-1 Financing Statement — we file a first-lien position on the contractor's receivables with the Secretary of State in every state they operate; (3) Federal Acquisitions Regulation (FAR) — legally requires government contracting officers to honor the assignment and pay ABR directly via ACH; (4) SAM/CCR Registration — we are registered in the federal System for Award Management, ensuring all federal payments route to us electronically; (5) Retired JAG Officer Advisors — two Judge Advocate General officers are on call for any federal contract dispute.
Yes. We can only discuss your account with you or with a person you have explicitly authorized in writing addressed to our President. We rigorously protect investor confidentiality and observe all applicable privacy laws. Your investment information is never shared with third parties for marketing or any other non-operational purpose.
Yes. Foreign investors may invest in the same promissory notes, with interest paid monthly by international wire transfer. A foreign investor cannot be a U.S. citizen or hold equity ownership in our company. U.S. tax withholding and reporting may apply to foreign investor payments; we recommend consulting a cross-border tax advisor about your obligations in your home country and any U.S. withholding requirements.
